1. About SunSwap

SunSwap is a peer-to-peer marketplace for buying and selling used beach equipment (sunbeds, parasols, and accessories) in and around Port de Pollença, Mallorca. SunSwap is operated by Olive Tree, based in Pollença, Mallorca. We are not a retailer — we are a platform that connects sellers with buyers and, optionally, provides physical storage through our Depot service.

2. Listings & Payments

  • Creating a listing costs a one-time €5 flat fee, paid via Stripe at the time of listing.
  • The €5 fee covers listing, storage (if depot is selected), and platform costs. It is non-refundable once the listing is live.
  • Sale proceeds go directly between buyer and seller — SunSwap does not handle the sale transaction.
  • Sellers are responsible for agreeing a fair price and completing the handover with the buyer.

3. SunSwap Depot

The Depot service allows sellers to drop off their items at our Pollença location before flying home. This means your listing stays active for the remainder of the season — increasing your chances of a sale even after your holiday ends.

  • Ownership: You retain full legal ownership of your item until it is sold. SunSwap holds the item on your behalf as a bailee.
  • Season end: Depot storage runs until the end of the beach season, typically late October. Items not sold by that date will be donated to a local charity or community organisation in Pollença. We will make reasonable efforts to notify you before this happens.
  • No winter storage: We do not offer winter storage. Items will not be held over to the following season and will not be returned to you after the season ends.
  • No guarantee of sale: Placing an item in the Depot does not guarantee it will sell. SunSwap makes no warranty as to the saleability of any item.
  • Condition: Items must be in the condition described on the listing. We reserve the right to refuse items that are unsafe, broken, or significantly misrepresented.
  • Drop-off arrangement: Drop-off times must be arranged in advance with the SunSwap team. Contact us at hello@sunswap.olivetree.es to arrange this.

4. Buyer & Seller Responsibilities

  • Sellers must accurately describe the condition, age, and contents of their listing.
  • Buyers purchase items as seen. SunSwap is not responsible for disputes between buyers and sellers.
  • Both parties agree to communicate respectfully through the SunSwap messaging system.
  • Listings must only be for genuine beach equipment — no other categories are permitted.

5. Liability

SunSwap takes reasonable care of Depot items but cannot accept liability for loss or damage caused by events outside our reasonable control (including theft, fire, flood, or acts of God). We recommend that sellers arrange their own insurance if the item is of significant value. Our total liability in any circumstances is limited to the €5 listing fee paid.

6. Privacy

We collect your name, email address, and listing details solely to operate the platform. Your contact details are never shared with other users — all buyer-seller communication happens through our anonymised messaging system. We do not sell your data to third parties.

7. Changes to These Terms

We may update these terms from time to time. The current version is always available at sunswap.olivetree.es/terms. Continued use of SunSwap after changes are posted constitutes acceptance of the revised terms.
